The expertise of trainers of the Romanian National Institute of Magistracy in the field of legal writing and argumentation, capitalized at the National Institute of Justice

On November 11 and 12, 2024, two seminars were organized at the National Institute of Justice dedicated to the development of the skills of drafting judicial and procedural documents. The activities directly respond to the recommendations of the 2022 TAIEX mission, which emphasizes the need to increase the quality of decision-making and legal reasoning by incorporating this dimension into the initial training curriculum.

The training sessions were facilitated by the trainers of the Romanian National Institute of Magistracy - Ionuț Victor Voina, judge at the Bucharest Court of Appeal - Second Criminal Section, and Vasile Bozeșan, judge at the Ilfov Court.

On the first day, the training program was addressed to INJ trainees, and on the second day, the activities took place with the participation of candidates for the positions of judge and prosecutor who were enrolled in studies this fall.

During the seminars, essential aspects regarding the drafting of court decisions were addressed, emphasizing the structure and reasoning of decisions in the matter of preventive detention, including the analysis of practical situations. At the same time, the methodology of the logical structuring of the argumentation of court decisions in the civil field and the ways of capitalizing on the jurisprudence of the European Court of Human Rights in their substantiation were presented.

The training activities are part of the project "Assistance in the field of justice - Strengthening the institutional capacity of the National Institute of Justice from the Republic of Moldova", implemented by the National Institute of Magistracy from Romania and the National Institute of Justice from the Republic of Moldova, financed by the Government of Romania - Ministry of Foreign Affairs through the International Development Cooperation Agency.
