Strengthening the powers of national judges in the application of EU law

During October 22-23, 2024, the National Institute of Justice hosted the seminar "The role of the national judge in the application of EU law", organized in partnership with the European Institute of Public Administration (EIPA). The purpose of the event was to strengthen the professional skills of magistrates from the national legal system in order to respond to emerging responsibilities in the context of relations between the European Union and the Republic of Moldova.

Present at the opening, the interim Director of the National Institute of Justice, Adrian Cerbu, mentioned the importance of the course, which supports our country's alignment with European standards. At the same time, Adrian Cerbu emphasized that among the objectives of the institution he leads is the inclusion, in the Continuing Education Plan for the year 2025, of a new module covering several topics related to the field of European law.

The training sessions were delivered by the experts of the European Center for Judges and Lawyers, based in Luxemburg, of the European Institute of Public Administration - Juan Diego Ramírez-Cárdenas Díaz and Dr. Carlos Santaló Goris, as well as the judge of the Câmpina Court, Romania, Radu Artiom.

During the training, the peculiarities of the European legal system were addressed, giving participants the opportunity to explore the legal instruments of the European Union and to understand the fundamental principles that must be taken into account when examining cases: the primacy of European Union law, direct effect and state responsibility. A special emphasis was also placed on judicial independence, dialogue with the Court of Justice of the European Union through the procedure of preliminary questions, as well as future judicial cooperation in civil and criminal matters.

On the sidelines of the event, the interim Director of the National Institute of Justice, Adrian Cerbu, had a meeting with the expert of the European Institute of Public Administration, Juan Diego Ramírez-Cárdenas Díaz. During the discussions, it was agreed on the continuation of the collaboration by organizing some necessary training programs in the context of the EU accession process.

The seminar "The role of the national judge in the application of EU law" took place thanks to the project "Supporting legal and institutional reforms required by the status of a candidate country" implemented by the Government of Luxembourg.
